This agreement is between SpringWeb, and the authorized person placing an order for this hosting account:

The Authorized Person will hereafter be referred to as "User."

1- Subject to the provisions hereof, the account will be opened upon reception of contract, and repeated in each successive billable period thereafter at the then applicable prevailing rates and charges, unless written notice of cancellation is received from User at least 7 days prior to the beginning of the next billable period.

2- Charges for "billable period rate" services are payable prior to the beginning of each period. Failure to pay in no way relieves the user's obligations to make full payment. User hereby agrees to pay any and all attorney fees, court costs, and related expenses incurred by SpringWeb in the collection of any amount due it.

3- SpringWeb may, with 30 days written notice, amend the rates and or charges for any future server usage and/or services.

4- User agrees to use all SpringWeb services and facilities at User's own risk. SpringWeb specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall SpringWeb be liable for any loss, or loss of data, or any other damages. SpringWeb only restores backup data in the event of a server loss.

5- User agrees to protect and indemnify SpringWeb against any and all liability, loss, or expense arising from claims of libel, unfair competition, unfair trademarks, trade names or patents, violations of rights and privacy and infringement of copyrights and property resulting from User's use of SpringWeb services.

6- SpringWeb reserves the right to cancel any account, at any time, without notice, for any reason SpringWeb considers appropriate. Use of the email system to send unsolicited email or Usenet postings is not allowed from any SpringWeb account. "Sexually Explicit Adult Content" is not allowed on a SpringWeb Server. At SpringWeb's discretion, access to SpringWeb's Internet Account may be revoked at any time for abusive conduct on the system and/or the Internet and its resources as a whole. ( See our acceptable use policy! )

7- User agrees not to use disk space provided by SpringWeb for uploading files not directly related to his web site. At SpringWeb's discretion, any such activities deemed inappropriate by SpringWeb may result in termination of access to SpringWeb's Internet Account. User also agrees not to use any server side program that requires unusual amount of server resources. If and when User web site's server processing usage exceeds what is considered usual, SpringWeb shall offer new pricing deemed appropriate for such usage by SpringWeb. If User declines the said offer, SpringWeb may cancel User account at SpringWeb's discretion. SpringWeb shall be the sole arbiter of what constitutes unusual amount of server resources. User agrees not to store any archival files in the disk space on SpringWeb's servers. 90% of files stored on the servers must be linked to the web site. Violation of this rule may result in termination of access to SpringWeb's Internet Account. Web sites designed to distribute software and/or multimedia files are subject to special pricing. For accounts under which the disk space is resold, the traffic allowance is halved and subject to special pricing.

8- User is solely responsible for usage of SpringWeb and any statement User makes on SpringWeb's system may be deemed a "publication " of the information entered. Acknowledging the foregoing, User specifically agrees not to use SpringWeb's service in any manner that is illegal, libelous, or against any SpringWeb policy.

9- SpringWeb reserves the right to cancel any services/account with out notice for reasons it sees as fit and just.

10- Each of SpringWeb's Web hosting plans except for as stipulated
below carries a 30 day money back guarantee as outlined in our
billing policy. If you are not completely satisfied with our
services within the first 30 days of your contract, you will be
given a full refund of the contract amount excluding any overages
and the setup fee. For Web hosting contracts the full monthly
contract amount except for setup fees, domain registration fees,
and charge for overages will be refunded if SpringWeb is notified
within the first 30 days following activation. However, any overage
charges AND a fee of $35 will be subtracted from your refund to cover
setup charge, regardless of whether your plan had any setup fees.
No refund is available after the 30th day. All cancellation request
must be submitted to SpringWeb by email or regular postal mail.
This 30 day money back guarantee as described above is not valid
with the following services: reseller accounts, domain parking and
domain registration services.


11- The billable service period begins on the date the services indicated in this agreement become available to User. Any traffic overage will be billed immediately after it occurs. Traffic overage will be calculated using monthly traffic limits.

I agree to allow Silver Palace International LLC (SpringWeb) to draft my check or charge my credit card an initial payment for internet services which includes the initial package price plus a one-time setup fee. I also agree to allow Silver Palace International LLC (SpringWeb) to draft my check or charge my credit card monthly for the service packages and monthly at the renewal price for the other packages after the initial package duration has expired. I understand that I will be contacted one week prior as a courtesy before renewal drafting commences, for any service package I have chosen. This agreement will be in effect until cancellation by either party in written notice at least 7 days before the due date.

12- Acceptance of this contract also indicated the User has read and agreed to our Acceptable Use Policy and Billing Policy (see terms of service).

13-I understand that SpringWeb prosecutes for credit card fraud to the fullest extent of the law. We capture IP addresses exactly for this purpose.

14-New Domain Registration With SpringWeb - The Applicant agrees to be bound by SpringWeb Domain Registration Term and Conditions, by the Registration Agreement as found at http://springweb.com/domain/agreement.shtml and by the Uniform Dispute Resolution Policy as found at http://springweb.com/domain/udndsp.html

I agree to the above terms and acknowledge that in pressing the Submit button, this form is sent to SpringWeb. An account will not be setup if this form is not received by SpringWeb.  The below for all intents and purposes is the equivalent to your on-line signature.
